FEDERAL DISTRICTS …ARE THERE DIFFERENCES?

Oh, boy…is there!

I worked all five boroughs as an FBI Agent: Manhattan, Brooklyn, Bronx, Queens and Staten Island (my birthplace), on criminal matters.

The preference for all criminal Agents was the Eastern District, back in the day. The Southern was very liberal, most AUSA’s were liberal wimps and not the least bit aggressive. There were exceptions. Rudy wasn’t liberal and had guts. I called him to present his first Bank Robbery case. He authorized the arrest, and we arrested the bad guy. There were other AUSAs in the Southern District I would call, but the Eastern was far better to deal with. They were mostly conservative and agenda free, unlike the Southern, my opinion! Now why would that be? You would think you present a case, give the Probable Cause (PC), and get the same opinion in both districts. Wrong!

It seemed most AUSAs in the Southern had an agenda.  The USA would always be liberal, for some reason, and not like normal people. More elite, again, my opinion. The Judges were sort of the same, but some were not very smart.

There was a very liberal Judge in the Southern District who insisted that the cuffs be removed when subjects were brought in for an initial appearance. He did not respect what the Marshalls or FBI Agents told him about the dangers of some subjects. To explain further, when the FBI makes an arrest, we are responsible for the prisoner until after he had his preliminary appearance. Once bail was set, we turned him over to the Marshall in Court, but because they were always shorthanded, we would escort the prisoner back to holding, with the Marshal.

One evening, after a chase, a fight, an escape attempt, and with a loaded 45 auto, my partner Steve and I arrested a guy with the nick name of Tony Cookoo, (why Cookoo…because he was nuts). In a previous encounter, he pulled that same gun on me, I backed off, took cover to fire but he gunned his truck and the chase was on. I caught up, he bailed and got away, we recovered three separate loads of stolen, truck-hijacked goods.

This next time when Steve and I got him on a different matter, he tried to run us off the road with a 24 ft. truck. When we finally caught him, he bailed out, with the truck rolling, ran in front of the truck, and the truck ran him over! He lived through it, and we brought him to the Holding Center for overnight. We brought him up to the Judges’ court, but we warned the Marshal who promptly warned the Judge that we want the cuffs and leg irons on. The Judge said “absolutely not”…I went in and warned the Judge myself, and the arrogant Judge said “get out”, which I did.

In court, the Judge read the charges and when he called Tony’s name, Tony said F— you several times, jumped up on the desk in front of the Judge, grabbed the Judge by the throat, and began choking the Judge. The Marshal moved quicker than we did, as we were still sore from the fight with Tony during the arrest. The Judge was shaken, accused us of being slow, and I accused him of being stupid. He learned a lesson, though, and kept the cuffs on prisoners when law enforcement requested, which was all the time.

I never had an Eastern District Judge, never heard of one, who wouldn’t listen to law enforcement! There’s the difference.

I am not the least bit surprised that a Southern District USA wants to follow an Agenda and investigate a person, the President. The AG should call that dipshit USA to WDC and read her the riot act. We do not investigate people…we investigate crimes and USAs do not investigate at all…they prosecute and if she doesn’t get it…fire her! It’s that simple!
